A state legal hearing in January has been set for the next hearing in the case against a village in north suburban Nye County that would have banned the sale of a popular garden grower's crop.

On Wednesday, a hearing is scheduled to be held at the state Supreme Court's Division of Municipal Affairs to consider a complaint stemming from a proposed May 8 hearing on the proposed sale.

Nye County will consider the claims of several residents who have requested the hearing in the recent three-judge panel review of the county's case.

The petition filed in a suit from one woman called to recall a popular home grower named Billie A. Alpert.
